Is it legal to have a statment from an intoxicated person to be upheld in a court of law

Its a little difficult to tell exactly what you are referring to. I don't know if this is a statement from live tesimony or a written statement, or someone repeating a statement. The rules of evidence are different on exactly what the circumstances are. When you say, "Is it legal.......," I assume your asking if it is admissible. It could be, but its hard to say without knowing exactly what you are referring to. A lot of things are admissible, and then its up to the judge or the jury to consider the credibility and truthfulness.
