Legal Question in Criminal Law in South Carolina

Move case

My god bother is in South Carolina in jail waiting a capital murder charge. He also has a murder case in Atlanta which happened first. Can he be sent back to Atlanta to face the charges there or do they keep him where the charge is more serious?

They can and mostly likely will take him back to Atlanta to face that charge. Both states have a right to prosecute him. Usually the offense that was committed first is the one that is tried first.
