Legal Question in Criminal Law in South Carolina

Polygraph

Recently my place of work was robbed. I was contacted by a detective that wants me to take a polygraph. After researching i found that polygraphs don't always work. Should I take it anyway?

Re: Polygraph

I am a criminal defense attorney in Myrtle Beach, and practice state-wide should you need any further help. I have been asked this question many times. It is a very intelligent thing to ask and I commend you for asking. However, it is also a difficult question to answer. You are right. Polygraphs are not always dependable. That is why they are not admissible in court. If I was to tell you to take it and then the polygraph indicated you were lying, then I would not be helping you much. On the other hand, if I tell you not to take it, and they consture that as being guilty and leads to an arrest, then I would equally feel like I wasn't doing you justice. Sometimes if you pass a polygraph they will stop investigating the person. Also, sometimes a person can pass the polygraph and still be arrested. So it all depends. It also depends on what other suspicions and possible evidence they think they may have. My best advise is to do some more reading on polygraphs, so that you know as much about them as possible, and then to be sure to consult with an attorney again before taking the test. This is important. An attorney needs to know as much about the situation, and then may be in a better position to advise you. You are welcome to call or email if you have any other questions. Good luck. Robert Johnston. Email: [email protected]
