Legal Question in Criminal Law in South Carolina
Public Drunkenness
I recieved a taxi cab ride home from a local bar, the taxi driver, dropped me off in a parking gargage instead of my apartment. I tried to walk the rest of the way back to my apartment with a borken foot. I tried to take a short cut through private property and was arrested for public drunkenness, and taken to a hospital for my foot. Two questions about this situation... is there any way to get out of the public drunkenness charge seeing that I tried to take the correct path home and take a taxi cab. And, I tried to refuse to go the hospital for my foot knowing that they would not fix it there, is there anything that can be done in relation to that... I know have a $900 hospital bill that I have to deal with. Thanks fro the help.

Re: Public Drunkenness
As far as the public drunkeness charge, you may be able to do something about it, but you really should consult with an attorney. The fact that you were dropped off in the wrong place really makes no difference. Just being in a taxi is still being in public. And if you were drunk in the taxi, then that alone is public drunkeness. However, it sounds like you were trying to do the right thing and an attorney could use that to your advantage. As far as the hospital bill is concerned, did you consent to treatment at the hospital or refuse treatment? That could make a difference. Good luck.
