Legal Question in Criminal Law in South Carolina
Recently, I was arrested for shoplifting at a store even though it was not on camera and the manager simply said she saw me playing with the merchandise. I was still arrested after they searched me and found none of the merchandise on me. All they could find was a earring in the parking lot of the mall. When the police got there they didn't even search or ask any questions. Could I sue the store and the police department for defamation of character and false imprisonment?

Before you can consider any sort of civil action against anyone related to your arrest, you need to favorably resolve the criminal charge. Bringing any sort of a civil action while the criminal case is still pending will usually not benefit you and usually just makes the victim want to pursue prosecution even more.
