Legal Question in Criminal Law in South Carolina
Hello. Recently, my brother, who is 17 years old, was arrested in South Carolina for charges of shoplifting. We are from Chattanooga, TN and he was there on vacation. He was transported to prison. What steps should we take and can we have a rough estimate of what to expect? I know about the updated law of $1000 fine and/or 30 days in jail.

Every one of these cases is treated differently. As to what to expect, it all depends on which court his case is in, since each court has different procedures, what if anything is on his record, how much and the quality of evidence there is, whether the alleged victim cooperates, whether there is any restitution, whether he has any defense, and so forth. There are additional considerations. Again, each case is handled on the facts and circumstances of the particular case. So without knowing more, I can't tell you what to expect.
I can tell you that if your brother or the family retains an attorney, it will make a big difference. At least in nearly all cases it does. First of all, when I am retained on these cases, I contact the court and get my client excused from the court date that he was given when arrested. That usually saves the person a lot of time and driving. It also continues the case to give me an opportunity to see what can be done for him.
Secondly, I go through the entire Discovery process. One of my goals any time I represent a young person like your brother, is to get this off their record. No one who is 17 years old should having a stealing conviction on thier criminal record.
I usually do not charge very much on these cases since I am a full time Criminal Defense attorney and already have a lot of on-going business with the courts.
