Legal Question in Criminal Law in South Carolina
re-opening old abuse case
My husband was charged with lewd assault on his 13 year old daughter in 1986 in south carolina. Since getting grown daughter has contacted us ,saying she knew the charges were false:her mother had used the system as a means of gaining custody which she had lost at time of divorce.Daughter alone with ourselves what to know now to get this overturned (we are on a very fixed income-my husband can't keep work(as soon as his status as an offender is discovered-he is fired). My husband served 19 months in jail plus probation and fines for something he did not do. We have poligraph test showing he told the truth and even a copy of an old doctors report showing no evidence penetration when examined by that doctor but weeks later(she was several states away with her mother)she showed signs of abuse. What can we do to start the ball rolling towards a review of this unjust conviction. thank you!

You never said whether he was convicted after a trial or if he accepted a plea and pled guilty. I would need to know that before answering your question.
