Legal Question in Criminal Law in South Carolina

Reporting a Stolen Vehicle

In my divorce decree it states that my ex-wife has until March 23, 2009 to return the vehicle to me if she doesn't refinance before then. She is now saying she won't give it back to me until she feels like it. In the state of TX (Where the divorce took place and I reside) if someone has permission to drive your vehicle, before reporting it stolen you must give them a 10 day notice telling them to return it before you can report it stolen, I have done some research and the court order works as well. She lives in SC and if she doesn't return it, is the court order stating the day it needs to be returned enough in SC to report it stolen if she hasn't returned by the court ordered date? Or will I need to send her some other form of notice. I have already notified her by phone that if it's not here the 23rd I will report it stolen. Thank you.

Re: Reporting a Stolen Vehicle

The best thing you can do is to consult with a Texas lawyer. You have submitted this question for a SC lawyer. However, the car in question is governed by Texas law as that is the state where the divorce order was issued. Also, when you consult with the Texas lawyer, but sure to inquire about reporting it stolen. It doesn't sound like it would qualify for a stolen vehicle. I'm afraid that if you reported it stolen the police would tell you that its a civil matter. Good luck
