sexual miscnduct

my friend was charged with 2nd degree sexual mis conduct when he was 17 and the girl was 14 but the police waite 2 days after he was 18 to arrest him and they try to charge me with contributing to the deliquency but i was also 17 and i was considere a ninor so they couldnt charge me but yet they still charged my friend can he get that overturned
