Legal Question in Criminal Law in South Carolina
shoplifting
My 17-year old daughter got arrested 1-week ago for shoplifting. She was with a friend who took 2 bottles of cough syrup from K-Mart but she didn't take anything and was unaware. Now K-Mart is trying to sue us. We can't afford an attorney. What can we do?

As far as the criminal charge is concerned, that is a very small case compared to other crimes and you might be able to find an attorney for just a few hundred dollars. I only charge $400 to $500 for those cases. She may also qualify for one of the alternative programs to prosecution which is nice since its often a means of getting the criminal record erased. As far as K-Mart sueing, they generally do not sue for much more than $150 on those kind of charges. If she doesn't want to fight it she may be able to work out some sort of scheduled payments to make it easier. I wish you well.
