Legal Question in Criminal Law in South Carolina

Simple Assault

My son is charged w/simple assault. He never touched anyone,however the man that called the police, threanted to kill my son with a gun and then walked away and threatened to kill my grandaughter. They say that is was charged for walking behind the other guy and cussing at him. The police said they could not prove Assault w/ Intent. My question is can someone be charged w/ simple assault because of words?

Yes. Assault is basically threatening someone. Battery is the actual physical act
