Simple Assault
If simple assault is threatening someone, then how can someone threaten to kill someone, telling them when and with what, and it not being a case of simple assault?

I don't understand your question. If someone treatens to harm another person then it is ASSAULT. Your asking me how it cannot be assault if they threaten someone and that doesn't make sense.
