Legal Question in Criminal Law in South Carolina

simple possession in SC

My son was arrested for simple possession. He saw the blue lights and threw the joint out the window. The cop saw him and he found the half of joint in the grass. Do u know if he will loose his licence? If so will he be issued a temp so he can go to work and school?

Re: simple possession in SC

If he is convicted of the charge, then yes he will lose his license for six months and no temporary license is available. Does he have any previous convictions and if so, for what? Depending on his record he may qualify for one of the alternative programs to prosecution such as PTI or one of the Diversionary programs. If so, then he will not lose his licence, pay no fine and when he completes the program they will destroy the arrest record, which is great for a young person.
