Legal Question in Criminal Law in South Carolina
My son has been charged with child cruelty what is the difference in the statutes between child cruelty and child abuse and which charge is the worst of the two
1 Answer from Attorneys
There are numerous statutes on various laws regarding Child Abuse. I cannot look it up unless I have a Code Number, which is on the paperwork. If you have the Code Number and send it to me, I will give you the answer to your question.
As far as Child Cruelty, that one is below.
63-5-80. Cruelty to children.
Whoever cruelly ill-treats, deprives of necessary sustenance or
shelter, or inflicts unnecessary pain or suffering upon a child or causes
the same to be done, whether the person is the parent or guardian or has
charge or custody of the child, for every offense, is guilty of a
misdemeanor and, upon conviction, must be imprisoned not more than thirty
days or fined not more than two hundred dollars, at the discretion of the
magistrate.
