Legal Question in Criminal Law in South Carolina

My son was charged with grand larceny and we have now learned that he should have been charged with petty larceny. What can we do to get that corrected? He was sentenced to 3 years and we have been informed that the sentence is not correct for the charge he should have been charged with.

He was sentenced to 3 years in jail or probation? If what you say is proveable then its an illegal sentence. An appeal is an option, but that is time consuming. If it was my case I would go back to the sentencing judge. He/she has the power to correct it.
