Legal Question in Criminal Law in South Carolina

a stabbing

have a friend who supposly stabbed a mexican, he turned himself in, mean while, the mexican was in the hospital, and during the night, just gets up and leaves. We find out that he is not legally here. Is there still a case here for the charge of A&B with deadly weapon, with intent to kill? being there is no victim thats going to show up in court

It all depends on what evidence they have. The prosecution will not likely be willing to dismiss a charge this serious any time soon. Did the victim idendify the defendant? What if they find the victim? Is there any other witnesses?
