Legal Question in Criminal Law in South Carolina
State versus itself
The state has committed a crime which can easily be proven. How does an individual press charges so that justice is served? Does the state prosecute itself? I believe that would be a conflict of interest especially when the crime resulted in damages.

It all depends. If a State official has committed a crime, it can be prosecuted by a State prosecutorial agency. Under certain circumsances it can be prosecuted by the federal govenment.
