Legal Question in Criminal Law in South Carolina

stolen dirt bike

My son, 16, was accused of stealing a dirt bike.....he was taken to the jail in a police car for questioning (I accompanied him in my car); he was not offered an attorney......He gave a statement explaining that he traded his go-cart for the dirt bike.....Now another police officer wants to talk with my son again to get more information......She said she wanted the name of the person my son got the dirt bike from, and said my son could be held liable......I explained again, that he did not know the boy.....I told her (at first) we would meet with her to answer more questions, but decided against without a lawyer present, which I cannot afford......I called the Sergeant back and asked if my son would have an attorney when we met with her......she said my son had not been charged, and that I could get a lawyer if I wanted. I told her my son did not have anything to add to his original statement. She was very angry, and told me that my son could still be held responsible if her investigation found evidence of his involvement.

Did I do the right thing in not meeting with the Sergeant????

Its hard to say. Sometimes talking with the police helps them clear up the situation and you never hear back from them. Other times answering their questions only causes more problems. The best thing to do at this point is to have an attorney. Good luck.
