Legal Question in Criminal Law in South Carolina
Technical Violation Of Probation For Marrying Someone On Parole.
I am currently on probation and want to know what my chances of going back to prison are for a ''technical violation''. I have been told by my Probation Officer that by marrying my fiance, (who is on parole), I will have to go in front of a judge for a technical violation. I do not have any violations, I have a full time job, I'll be attending college full time Fall semester & all my fees have been paid on time or ahead of schedule. The Probation Office has already allowed me to visit with him once, but won't approve his transfer from MT to SC because we are not married. Nonetheless, they are telling me that if I get married to him they will have to give me a technical violation. What are my chances of being sent back to prison?

Re: Technical Violation Of Probation For Marrying Someone On Parole.
It would be helpful to know a little more information. However, assuming all else is well with your case, based on prior violations that I have seen I would say that your chances of going back to prison are probaby not too strong. Again I would need more information and could probably give you some tips on how to be prepared for whats to come. Your welcome to call. Robert Johnston 843-828-1137. By the way, how long have you been on probation and what did you plead to?
