Legal Question in Criminal Law in South Carolina
Unlawful use of telephone
If someone has been charged with unlawful use of telephone and has to go before a judge for a hearing do they have to have an attorney? They admit to sending the text messages it was a two way argument but they did not save their text messages and not interested in fighting the charge. When they go before the judge should they just plead guilty or can they plead no contest without having an attorney present. 1st offence, never been in trouble, and will be the last, lesson learned.

Re: Unlawful use of telephone
A person is not required to have an attorney. However it is extremely advisable.
