Legal Question in Criminal Law in South Carolina

Vehicle Seized

I stopped at a liscence checkpoint and upon giving the officer my liscence another officer noticed that a passenger had marijuana in his possession, he searched him again and then asked that I step out of the vehicle, upon searching me they found 3 grams of crack cocaine. We were both arrested and my vehicle was impounded. Since then my passenger has claimed full responsibility for all narcotics found, but I have yet to hear anything about my vehicle what should I do?

I'm not sure if your asking about your car or your drug arrest. You should be able to get your car back. Its a rather involved process and you should consult with a lawyer to do so. Its a bit much to type in here all that might need to be done to get it back. As far as the drugs are concerned, I don't think it will matter too much to the prosecutor that your passenger took responsibility for the drugs found on you. I assumed you were arresed on a possession charge. The fact that your passenger took responsibility for the drugs on you probably won't make much of a difference, since the drugs were found on you and therefore, you were in possession of the drugs. I would be happy to answer any other questions you might have, including how to get your car back. Robert Johnston 843-828-1137
