Legal Question in Criminal Law in South Carolina

Wallet Found

My child found a wallet at school. Decided to keep the money found in the wallet. School adminstration found out. Police officer interrigated my child in my absence and have charged my child with the criminal offence of stealing or Petty Larceny. Is it stealing or Petty Larceny if you find a wallet and decide not to turn it in or give it back to it--name removed--owner?

Re: Wallet Found

Its almost a gray area. The problem is that he took the money out of the wallet. It would have been different if he had left the money in it. I really need to know the exact name of the criminal offense they charged him with. You cited both "stealing" and Petty Larceny. There are numerous types of theft charges. If you have a ticket or a warrant and would like more information, you can call and give me the exact name of the charge or the Code Section number and I can better answer your quesiton.
