Legal Question in DUI Law in South Carolina

Duac

I was pulled over and given field tests. I was taken to Jail but was very cooperative with the police... I blew a 0.10 breath test and was given a DUAC. How is that diff. from a DUI? This is my first one. Do I need to get a lawyer?

Re: Duac

DUAC and DUI are very similar, but the elements are slightly different. The penalty is the same. The good news is that you only blew .10, which is just a little bit higher than the legal limit of .08. Some of these cases get reduced to a lessor charge, such as Reckless Driving, especially if there is no evidence of impaired driving. As far as needing a lawyer, I believe you do. DUAC is considered a serious offense. You are welcome to call or email me at [email protected] if you have any other questions. Robert Johnston
