Legal Question in DUI Law in South Carolina

Dui and Medical Bills' Responsibility

I was arrested for my 1st offense DUI earlier this year. I was the driver in a 1 car accident. At the time, I was too banged up to go straight to the detention center to take a breathalyzer test. Instead, under the jurisdiction of the highway patrol and after I received my ticket, I was taken in an ambulance to the emergency room. Since I do not have insurance, I informed the hospital personnel about this and asked that they not conduct any unnecessary tests. However, I now have about $10k of bills that were useless in their execution. My only injuries were a small cut on my forehead and a 3'' cut on the top of my head. They even x-rayed my feet, even though I walked into the hospital! I have been told that if you are in police custody at that time of medical service, that you are not responsible for any medical bills associated thereto. Thank you in advance for your assistance.

Re: Dui and Medical Bills' Responsibility

I think you have been misinformed about not being responsible for medical bills because you are in police custody. I cannot tell you whether you are obigated to pay the bills unless I reviewed the medical reports. Its possible that the hospital made the decision that you were not capable of deciding what treatment needed or didn't need. In any event, if you want to contest the medical bills you should have the reports reviewed.
