Legal Question in DUI Law in South Carolina
I recieved a DUAC in soth carolina in November 2009. I recieved a DUI on Sept. 2010 I failed the field test but refused the breathalizer test. but was charched second offence DUI. My question is -Can I be charged with second offence DUI if I this charge on Sept. 18th is my first DUI and prior to that I was guily and charged with DUAC November 2009(and paid all fines and completed adsap and have had SR22 insurance as required.) ?

The two are treated the same for that purpose. But keep in mind that should you proceed without an attorney, some of these Second Offenses are reduced to a First Offense through the plea negotiation process.
