Settlement for Daughter

My daughter (20) was rear-ended by a drunk driver. His insurance has already paid for her car(totaled). She will have medical bills around $15000 but no permanent damage. What would be a reasonable settlement? Is she compensated for pain and suffering? What about punitive damages?

Its hard to just quote a specific amount. Anytime I have one of those cases it has to be evalated on a case by case basis. It depends on the policy limits, how long ago it was, documentation from the doctors that substantiate not only past medical treatment but also the possibility of future medical treatment and its projected costs. We also need to consider lost wages and out of pocket expenses, and any possible scaring, disfigurement, physical limitations. Then there is the looking into any additional coverage such as Excess Coverage, Umbrella Policies, including UIM Policies, etc. As far as punitive damages, that all depends on what particular laws are involved and/or the outcome of any citations the at-fault driver received. As with pain and suffering, that too is compensible, but will depend on how the medical reports can be interpreted and applied. Every case has its own particular set of things to be considered.
