Legal Question in DUI Law in South Carolina

simple possession of marijuana

My car was parked, and was searched with my consent. Marijuana was found, but neither myself or my two co-defendants claimed it. One was found with paraphenalia on her person. Both of them plead guilty- and I opted to do PTI. I have been in PTI since January 2009. All of my drug tests were negative, and I completed everything that was asked of me except the community service hours. I was enrolled in school full time and am working full time. My case is now being referred back to court. I am not guilty but I was once told in SC, ''the hand of one is the hand of all.'' What should I do when I go back to court?

Re: simple possession of marijuana

Hopefully you have an attorney. You can plead guilty and get it over with if you want. Depending on whether you have a record, you might be able to expunge it in 3 years. You also have the right to have a trial. You can email for any other questions. Robert Johnston
