Legal Question in DUI Law in South Carolina

South Carolina/NJ Reciprocity arrangements on DUI

If a person gets a DUI in South Carolina with a NJ drivers license do they lose their license in NJ? If so then for how long on a first offense? Thank you.

Re: South Carolina/NJ Reciprocity arrangements on DUI

Some states do not impose the same penalties as South Carolina would. It gets trickly depending on the particular state, but there are creative things that can be done. We have a lot of people from North Carolina come here and when they get a guilty conviction we do a special order signed by the judge called a "Nolo Contendere" in which the state of North Carolina will not recognize. That way they do not lose thier license in North Carolina, only their driving privleges in South Carolina are suspended. Robert Johnston

New Jersey will impose the same period of suspension as it would if the dwi occurred in New Jersey.

In New Jersey, for a first offender, an .08 to a

.10 is a 90 suspension. As a first offender, a reading of .10 or higher requires at least a seven month suspension of New Jersey driving privileages.

I do not know what reading makes one presumptively dwi in South Carolina; in some states it might be as low as .05.

When you get the suspension notice from New Jersey call me. It might be possible to reduce whatever suspension you receive.
