Legal Question in DUI Law in South Carolina

Suspended License?

I was arrested for a DUI two weeks ago and refused the breathalizer. I then received a notice from the DMV saying my license has been suspended for a year and no special driving privledges were available to me. I understand I can obtain an administrative hearing with the DMV to obtain a provisional. My question is, if I do obtain a provisional does the fact I can ''keep it'' hinge upon the outcome of the actual court case (a.k.a. I'm convicted of a DUI) or the administrative hearing and the outcome completely seperate from the DUI case?

The administrative hearing is separate from the actual court case. It only pertains to whether the initial suspension will remain in effect or not. It gets rather confusing. If you are convicted on the DUI charge there is another suspension period, but you can also get a temporary license. Call if you need all the details. Robert Johnston
