can I be charged 1st offense dui when Ive already had a dui

Yes, for two reasons. One, they only go back 10 years. Two, when a person is arrested the police do not always do a thogough background check and sometimes the previous DUI does not show up. But you have to be careful because if it IS within 10 years, then the new ticket can always be amended to a DUI Second Offense.
