Legal Question in Family Law in South Carolina

18 year old suppor issue

At what time does the motion need to be filed in the court if the child turns 18 before she finishes high school, or is this issue discussed when the NCP petitions the court at the age of 18 to get the support stoped.

Re: 18 year old suppor issue

Typically, child support is stopped at the later of (a) the child turning 18 or (b) graduating from high school. If you are paying support and wish to stop it, most Clerks of Court only require you to submit proof of (a) or (b) above. If there is more than one child involved, then it will be necessary to file a Motion to recalculate the child support for the remaining children.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
