Legal Question in Family Law in South Carolina
adultery
My wife separated on Jan 06, signed a temp agreement in Feb 06.
I returned to the house for two weeks in Mar 06. We were trying to reconcile but had interference from the parents. We spent nights together throughout the year until Oct. because I would not settle for what I would be entitled to. In Nov 06 she started seeing someone who is now verified to be living with her in our marital home by an investigator. she is refusing to settle things and she does not know that her relationship is now documented by the investigator. I have rec'd vulgar messages from him by text messaging. I know what can be done with her legally. My question is, what can be done to him?

Re: adultery
Several years ago, South Carolina took away your right to sue him in civil court for money damages in a type of case that was called "alienation of affection".
If you have children, the Family Court may issue an Order requiring your wife to keep the children away from him.
If he is harassing you, you can attempt to obtain a Restraining Order in Magistrate Court, though the requirements for this vary from county to county.
Good luck.
