Legal Question in Family Law in South Carolina
Advice on how to get custody returned to myself.
I gave my mom temporary custody of my now 9 year old daughter just until I got of school, which was a 2yr college. Now that I have graduated and I am ready to get her back my mothe is not willing to give her back to me and wants me to go to court to get her back. I live in Atlanta and they are in South Carolina. Right now I can't afford to hire a private attorney and Pro Bono will only take my case if my mom signs a notarized statement agreeing to return the child to me, my mom disagreed. My child wants to come home and I am ready for her to return home, I also have 4 other kids in the home which are her brothers and sisters. I would like to know what are my options and can I petition the Family Court in South Carolina without attorney representation? If so how do I get the forms that I need because the clerk of the courts was no help at all and stated that she couldn't give me that information. Also my mom is collecting welfare and foodstamps for my daughter against my wishes and has started back using drugs, whic makes it an unsafe environment for my daughter.

You can file an action yourself, if you know what to file, how to file it, etc. If your mother does not have legal custody, you should be able to just to retrieve the child without having to go to Court.
