Legal Question in Family Law in South Carolina

alimony

I earn a much higher sallary than my husband. He is retired and work on a part time job. Since he is much older than I am, he is on a fixed income, would I be required to pay him alimony if I leave him and subseequently file for a divorce?

Florida Law - In florida either spouse may be awarded alimony. The court would review elements such as the term of the marriage, age and health of party requesting alimony, need of that spouse, ability of the other spouse to pay alimony, standard of living during the marriage and other elements as well. This issue is handled on a case by case basis and would be reviewed by the attorney handling the divorce. I am not familiar with the law in South Carolina and suggest that you speak with an attorney in your area.
