Legal Question in Family Law in South Carolina
Annullment/cild involved
I went before a judge 3 yrs. ago for an annullment. He granted a continuence on basis of my son. We represented ourselves.Since, my ex has gotten remarried even though we aren't officially annulled, divorced. He was told he had to give the son to me if (ex) wanted anullment. Im recovering from cancer and am very stapped for funds. Can someone help me get this taken care of and help me get my son and my legal anullment? Please? I am running out of time and I've tried to get the ex to respond, but he says it doesn't matter. He won't even let me see our son and pretends I am just making all of this up. Please help me. I can't move forward without my son or an anullment. He broke the law, but the police won't even give me the time of day. Help?

Re: Annullment/cild involved
If your husband remarried before getting divorced from you or having the marriage annulled, then he is committing bigamy, which is still a felony in South Carolina. You can still pursue a divorce or annulment at this time, but the annulment will be more difficult to obtain because of the length of time that has passed. Also, if he is keeping your son away from you without just cause, you can use that as a basis to seek custody of the child.
These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
