Legal Question in Family Law in South Carolina
what is the best way to approach custody rights for a child if your not married and just dating a girl who has the child with her. Also we don't live together and she is threatening to change the last name on the birth certificate. My name is on the birth certificate. I was wondering if she could legally do that and also the best way to file for custody

You should consult an attorney to discuss the steps in filing for custody and the odds of prevailing. As for the name change, she can attempt to change it, but you will be named as a party to that action and thus have a chance to give your opinion on same.
These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
