Legal Question in Family Law in South Carolina

change of custody

In what state would a change of child custody take place if the child and custodial parent live in South Carolina and the other parent lives in Georgia? The original decree was handled in Ga. and the child and custodial lived in Ga. until one year ago. Would the child have any input in the decision? He is 14 years old.

Re: change of custody

Georgia will usually retain custody, but there are exceptions. You should seek counsel to see if an excetions applies. Also, in GA a child over 14 can decide which parent they want to live with and the court will allow unless the other parent can prove unfitness.
