name change

do i have to have a lawyer for my son to have his last name changed to mine? do i have to have his father's permission?

It is possible for anyone to represent him/herself in Family Court, but it is generally not advisable. The person must know what to file, follow the proper rules of procedure, etc., which most people do not know how to do. Also, if any mistakes are made now, they can have long term consequences, which may or may not be able to be corrected down the road.

You will be required to give the father notice of your request for the name change, and he will have the opportunity at that point to consent or object. There are many factors which come into play with a minor's name change, so it's impossible to say at this point whether it will be granted or not.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
