name change for a minor

i'm getting married in a few days and would like to change my three year old sons last name. His biological father was not listed on the birth certificate, but he has been paying child support. What process must i go through to change his name and can i do this without dragging his biological father into this because i have no clue how to get in touch with him?

In order to change a minor's name, there are several legal requirements that must be met, including naming the other parent as a party to the case, serving him/her, and having a Guardian ad Litem appointed for the child during the process. If the other parent cannot be located, then they can be served by publication, though that takes longer and costs more.
