Changing last name

Can I change my daughter's last name from her father's last name to mine without his consent? We're not married.

Re: Changing last name

In order to change the child's last name, both parents must be made parties to the Court action and a Guardian ad Litem must be appointed to protect the child's interests. Then, the Court must find that the requested name change is in the child's best interest.
