Changing my childs last name.

My son has a different name than I because the man i was with at the time of his birth had asked me to marry him. Since then this man has married someone else and I have not be able to locate him. My son has his last name even though he is not listed on the birth cirtificate. My son is 3 years old and I would like for him to have the same last name as me. How do I get it changed?

In order to change a minor child's name, an action must be filed in Family Court. There are several procedural requirements that must be satisfied, including serving a copy of the action on the other parent and having a Guardian ad Litem appointed for the minor child.
