Legal Question in Family Law in South Carolina

changing residence

if my son got his divorce in florida and claims residency there, but is in the military ( presently S.C.) can he file in S.C. to petition more visitation ( possible custody ). Plus if he can, will that change grandparents rights? He is having a great deal of problems with his ex. They have joint with primary with her, but she claims that gives her the right to dictate when and where he can take his son.

Re: changing residence

If they are both legal residents of FL, then that state likely has jurisdiction there. If both have lived in SC for any period of time, then it may be possible to file and pursue the case if they both agree to do so.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
