Child Abandonment

Scenario: Mother has custody of two children by two different men. Mother calls the father of child #1 and tells him she cannot provide for the two children and asked him to come get them and take care of them until she can get on her feet. How long before he can claim abandonment?

She is not really abandoning the children if she is leaving them with someone who can take care of them, particularly if that person is the child's father. If he wants to try to get custody of the child though, then he can file as soon as he wants to do so.
