Legal Question in Family Law in South Carolina

If a child is born out of wedlock and the mother does not give the child the fathers last name and the father does not sign the birth certificate how does the law determine legal rights and responsibility of either adult to the child

This is a simple question that has a very complicated answer. There is a statute that says that mothers have custody of children born out of wedlock until the Court addresses paternity and other issues, but the purpose of the statute is to prevent baby snatching
