can my exhusband get custody of my 13 year old with domestic violence charges on him

In a child custody case, there are very few factors which are not relevant and considered by the Court. A criminal charge of CDV may or may not affect the case for several reasons.

First, just because he is charged doesn't mean he is guilty (presumption of innocence). Also, if the child was not present or affected by the alleged incident of domestic violence, it will likely have less impact on a custody decision.

Child custody cases are very complex, and it is important that they be handled correctly. Therefore, you should consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
