i am the grandparent i have the child in my home for most of the 10 years of the child life the father has never paid child support do i have to have legal custody of child to seek support from him?

You will need to seek an Order requiring him to pay child support to you, and I would anticipate the custody issue being raised at that time.
If you have had the child for ten years and haven't had custody, you are very lucky that no problems have arisen to this point, but the custody situation certainly needs to be pinned down to avoid complications in the future.
