Legal Question in Family Law in South Carolina

Child Custody

We live in South Carolina. My son has had physical custody of his two children for the last four months. Their mother has never sent any money to help them and she lives in Ohio. She has been here to see them once in the last four months and now she has served my son with custody papers. Does he have a good chance at keeping his kids? One of the children has autism and is in therapy and school. The other child is ten months old.

The Court always takes into account which parent has done what for the children as part of determining what is in the children's best interest. Certainly, the fact that he has had the children with him over the last four months is a big plus for him.
