Legal Question in Family Law in South Carolina

child custody

Mother of 3-divorced since 2000-joint custody with primary residence with their father-4 years ago he moved to Indiana but still to go by SC laws..oldest son, who will be 18 in Dec, wants to come live here for his senior yr...in the past and now his dad refuses to allow him to move but states he can do what he wants when he turns 18..son doesnt' want to wait till december and then switch schools in the middle of the year..he wants to come to SC at the end of this school year so he can get a job over summer and start school with the other students in Sept..I didn't want to have to go thru the drama or expense of the traditional custody battle when we are so close to him being 18...do we have any other options?

Without looking at your Order it's hard to say, but you will most likely have to file an action to get this done. However, with a child that age, the Court will put a LOT of weight on what the child wants.
