child custody

my sons father is not on his birth certificate and was taken today and placed in his care until the emergency hearing monday how can that be done

If he is your sons father, he need not be on the birth certificate to have parental rights.

If there is an emergency hearing, then there has to be an Order setting that hearing, and that Order can also specify which parent has custody until that hearing. Simply because the father is not on the birth certificate does not mean that he isn't the father and/or that he doesn't have rights.
