child custody

my ex wife and I have joint custody. Can my son be taken away from me for committing a misdemeanor. charged and released same day and paid fine. it is not over. my son is 10 years old

Without knowing much more information, it is impossible to answer your question. For instance, whether the child was present or not is important, as is the nature of the criminal offense itself.

Speeding is a misdemeanor, and if the child wasn't in the car, I wouldn't think that the Court would care. However, possession of marijuana when the child is present might yield a different result.
